Terms of Service

Welcome to CyprusBiz Academy. These Terms of Service ("Terms") govern your access to and use of our website, services, and educational courses. Please read these Terms carefully before using our services.

By accessing or using our services, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use our services.

1. Definitions

In these Terms:

  • "CyprusBiz Academy," "we," "us," or "our" refers to CyprusBiz Academy, operating in Cyprus.
  • "Services" refers to our website, educational courses, workshops, resources, and any other services we provide.
  • "User," "you," or "your" refers to any individual or entity accessing or using our Services.
  • "Content" refers to all materials, information, text, images, videos, graphics, data, and other content available through our Services.

2. Account Registration

To access certain features of our Services, you may need to register for an account. When registering, you agree to:

  • Provide accurate, current, and complete information
  • Maintain and promptly update your account information
  • Keep your account credentials confidential and not share them with others
  • Be solely responsible for all activities that occur under your account
  • Notify us immediately of any unauthorized use or security breach of your account

We reserve the right to suspend or terminate accounts that violate these Terms or that have been inactive for an extended period.

3. Course Enrollment and Payment

3.1 Enrollment

When you enroll in our courses, you agree to:

  • Meet any specified prerequisites or eligibility requirements
  • Participate in the course in accordance with our academic policies
  • Complete the required assignments and assessments as applicable

3.2 Payment

By enrolling in a paid course, you agree to pay all applicable fees. Unless otherwise specified:

  • All fees are quoted in Euros (€)
  • Payment is due at the time of enrollment unless a payment plan is arranged
  • We accept major credit/debit cards and other payment methods as specified at checkout
  • Prices are subject to change, but changes will not affect courses for which you have already paid

3.3 Refunds

Our refund policy is as follows:

  • For courses that have not yet started, full refunds are available up to 14 days after enrollment or until the course start date, whichever comes first
  • After a course has started, refunds may be available on a pro-rated basis within the first week of the course
  • No refunds are available after the first week of a course
  • Administrative fees may apply to all refunds
  • Special circumstances may be considered at our discretion

4. Intellectual Property Rights

4.1 Our Content

All content provided through our Services, including course materials, videos, presentations, and documents, is owned by CyprusBiz Academy or our licensors and is protected by intellectual property laws. You may not:

  • Copy, reproduce, distribute, or publicly display our Content without our permission
  • Modify, create derivative works, or reverse engineer our Content
  • Use our Content for commercial purposes without our written consent
  • Remove any copyright, trademark, or other proprietary notices from our Content

4.2 License to Use

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable license to access and use our Content solely for your personal, educational, and non-commercial purposes.

4.3 User Content

You retain ownership of any content you submit, post, or display through our Services ("User Content"). By providing User Content, you grant us a worldwide, royalty-free, non-exclusive license to use, reproduce, modify, adapt, publish, and display your User Content for the purpose of providing and improving our Services.

You represent and warrant that you own or have the necessary rights to your User Content and that it does not violate any third-party rights or applicable laws.

5. Acceptable Use

When using our Services, you agree not to:

  • Violate any applicable laws or regulations
  • Infringe upon the rights of others, including intellectual property rights
  • Share your account credentials or course access with others
  • Record, reproduce, or distribute course sessions without permission
  • Engage in any activity that interferes with or disrupts the Services
  • Attempt to gain unauthorized access to any part of the Services
  • Use the Services to transmit harmful code, spam, or malicious content
  • Harass, abuse, or harm another person or group
  • Impersonate another person or misrepresent your affiliation with any person or entity

6. Privacy

Your privacy is important to us. Our Privacy Policy explains how we collect, use, and protect your personal information. By using our Services, you consent to our collection and use of information as described in our Privacy Policy.

7. Term and Termination

These Terms will remain in effect until terminated by either you or us:

  • You may terminate these Terms by discontinuing use of our Services and canceling your account
  • We may terminate or suspend your access to the Services at any time for any reason, including if you violate these Terms

Upon termination:

  • Your access to our Services will be revoked
  • Your account and enrollment information may be deleted
  • You may lose access to any course materials or User Content
  • Provisions of these Terms that should reasonably survive termination will continue to apply

8. Disclaimers and Limitations of Liability

8.1 Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Services will be uninterrupted, secure, or error-free, that defects will be corrected, or that the Services or the server that makes them available are free of viruses or other harmful components.

We make no guarantees regarding the outcomes, results, or employment prospects that may result from using our Services.

8.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL CYPRUSBIZ ACADEMY, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST DATA, PERSONAL INJURY, OR PROPERTY DAMAGE RELATED TO OR ARISING OUT OF THE SERVICES.

IN NO EVENT WILL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS RELATED TO THE SERVICES EXCEED THE AMOUNT PAID BY YOU TO CYPRUSBIZ ACADEMY FOR THE SERVICES IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE LIABILITY.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN WARRANTIES OR LIABILITY FOR CERTAIN DAMAGES, SO THESE LIMITATIONS MAY NOT APPLY TO YOU.

9. Indemnification

You agree to indemnify, defend, and hold harmless CyprusBiz Academy, its affiliates, officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from:

  • Your use of the Services
  • Your violation of these Terms
  • Your User Content
  • Your violation of any rights of another person or entity

10. Modifications to Terms and Services

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on our website with a revised "Last Updated" date. Your continued use of the Services after such changes constitutes your acceptance of the modified Terms.

We also reserve the right to modify or discontinue the Services at any time, with or without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation of the Services.

11. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Cyprus, without regard to its conflict of law principles.

Any dispute arising out of or relating to these Terms or the Services shall be resolved through:

  1. Informal negotiation: You agree to attempt to resolve any disputes informally by contacting us before pursuing other remedies.
  2. Mediation: If informal negotiation is unsuccessful, the parties will engage in mediation with a mutually agreed-upon mediator in Cyprus.
  3. Arbitration: If mediation is unsuccessful, the dispute will be resolved through binding arbitration in Cyprus in accordance with the rules of the Cyprus Arbitration and Mediation Centre.

Exceptions to this dispute resolution procedure include actions to protect intellectual property rights and the right to seek injunctive relief in a court of competent jurisdiction.

12. Miscellaneous

12.1 Entire Agreement

These Terms, together with our Privacy Policy and any other legal notices or additional terms and conditions provided by us, constitute the entire agreement between you and CyprusBiz Academy regarding the Services.

12.2 Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. The waiver of any such right or provision will be effective only if in writing and signed by an authorized representative of CyprusBiz Academy.

12.3 Severability

If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced to the fullest extent under law.

12.4 Assignment

You may not assign these Terms or your rights and obligations under these Terms without our prior written consent. We may assign our rights and obligations under these Terms without restriction.

12.5 Force Majeure

We will not be liable for any failure or delay in performance resulting from causes beyond our reasonable control, including but not limited to acts of God, natural disasters, pandemic, war, terrorism, riots, civil unrest, government action, labor disputes, or internet service disruptions.
